ASSIGNMENT AGREEMENT

This Assignment Agreement no. [Contract Number] (hereinafter referred to as: "Assignment Agreement") is made and entered into as of [Date], between the following parties:

("Air Fair Pay" or "Assignee")

The Assignor and Assignee shall collectively be referred to as the Parties and individually as a Party.

The Client hereby assigns and transfers to Air Fair Pay full ownership and legal title to the monetary claim. This assignments include the Client's legal rights to claim under Regulation (EC) No 261/2004 of the European Parliament and of the Council of 11 February 2004 or under Law on Obligations and the Foundations of Property-Legal Relations in Air Traffic of the Republic of Serbia ("Official Gazette RS", no. 87/2011 i 66/2015) or under any other international or national regulation applicable to the Client in another country that establishes uniform rules on compensation and assistance to passengers in cases of denied boarding, flight cancellations, or significant delays. The Assignee fully accepts the transfer and hereby acquires the Client's rights.

The monetary claim being assigned specifically pertains to the flight with the following details:

Under this Agreement Assignee received the full ownership of the claim and is entitled to perform all legal and factual actions originaly pertaining to the assignor, specifically without limitation to:

Take any legal or factual action before the carrier or travel agency ("Defendant"), third party, or legal authority concerning the Claim's compensation,
Submit the legal action in order to initiate any judicial, administrative or extrajudicial proceeding in order to compensate the claim against the Defendant,
Collect and receive all payments related to the Claim, including but not limited to compensation, damage reimbursements, fees, interest, and any other legal costs from the Defendant,
Retain an attorney at law or other counsel to provide assistance with pursuing the compensation of the Claim against the Defendant.

This Assignment Agreement is made in accordance with the Privacy Policy and General Terms & Conditions provided at www.airfairpay.com which the Client expressly accepts by signing this Assignment Agreement.

If this Assignment Agreement is not recognized as a valid assignment in a specific jurisdiction, the Parties agree that this document shall be interpreted as a legal power of attorney granted to Air Fair Pay to represent the Client's interests in pursuing compensation from the Defendant.

This Assignment Agreement is valid as of the date of signing by the Parties or from the date of notifying the Defendant or any third Party if such conditioned by the local law.

The Client confirms that he/she have not assigned or transferred the Claim to any third party prior to signing this Assignment Agreement and agrees not to assign or transfer the Claim after signing without the prior written and explicit consent of Air Fair Pay or accept any direct payments from the Defendant. Should the Client assign the Claim in violation of this provision after the conclusion of this Agreement, it shall be liable to reimburse Air Fair Pay for all damages, costs, and fees previously incurred in connection with the collection of the claim including but not limited to the administration fees, attorneys and court fees.

This Assignment Agreement is terminated if the Client provides the withdrawal notice to Air Fair Pay within 14 days as of the execution of this Assignment Agreement, which would not apply if the agreement is already fully performed within the prescribed period.

This Assignment Agreement is written in [Language 1] and [Language 2] language, in case of discrepancy the [Primary Language] version shall prevail.
